Access agreements are routine in New York City construction. If the agreement is drafted properly with important provisions in the event of default including nonpayment is important. Escrows and upfront payment provisions are helpful as suggested in this article but a well crafted attorney fee provision in favor of the non-breaching party, and other provisions can be the difference between a difficult enforcement and an easy one. Properly crafting these access agreements so that these types of provisions are contained therein is imperative.
